Pursuant
to the authority cited below, administrative fines assessed for the
violation of University parking regulations may be deducted from the
salary and wages of University employees if such fines are not paid
voluntarily. Prior
to resorting to the payroll deduction process for the collection of
parking fines, every effort is made to encourage an employee to make
payment voluntarily. This collection effort includes the parking ticket
itself, and follow-up letters sent from the Parking Services Office. These
follow-up letters are sent at an early date so that parking fines may
be cleared before the deduction process is implemented. Further, a parking
fine procedure has been provided. (Please refer to procedure 851, "Appeal
of Parking Tickets".) When
the above efforts have failed to result in payment in outstanding fines,
such fines may be deducted from the salary or wages of the person. This
is accomplished with the following guidelines: 1. Payroll deductions may be made when an employee
accumulates unpaid fines, or 2. When an employee leaves State service. (NOTE:
Salary or wage checks are not withheld due to unpaid parking fines unless
there is insufficient time for the procedure to be followed, as in the
case of termination.) The
procedure for deducting from payroll checks is: 1. To deduct the uncollected fine from a payroll check,
a dollar amount is entered as a deduction in PAYSR. This request must
be made in writing from Parking Services to the Payroll Office. 2. For the following payroll, once a goal amount is
met for the deduction, the deduction stops. The
authority for the above is described in SUNY Administrative Policy 152
(4/25/73) and the following statement prepared by the SUNY Counsel's
Office: "Chapter 148 of the Laws of 1972, adopted by
the New York State Legislature enacted 362 of the Education Law authorizing
the Trustees of State University to promulgate parking regulations,
including the assessment of fines for the violation thereof. This legislation
permits the deduction of such unpaid fines from the salary or wages
of an employee of the University. Regulations (BNYCRR, Part 560) of the Trustees enabled
he Council of each state-operated institution to develop parking regulations
subject to Trustees approval. The Council for the State University of
New York at Binghamton has adopted parking regulations including the
assessment of fines for violation thereof and the deduction of such
unpaid fines from the salary of the offending employee. These regulations
have been approved by the Trustees of the State University." |
